Exemption: Content Produced by Third Parties

The operators or owners of leaksphotos.com are not the "producers" (either primary or secondary) of any material that may be explicitly sexual in nature, regardless of authenticity, that is exhibited on that website. The operator of said website just undertakes the activities of transmission, storage, retrieval, hosting, or formatting of content, which may feature explicit sexual conduct, that appears on the website as the result of actions taken by third-party users. All parts of the website that present user-provided content are under the control of the associated user. Therefore, the website operators and owners are exempt from compliance with Section 2257 records keeping and labeling obligations as prescribed in 28 C.F.R. §75.1(c)(4). Any content that is held to be illegal, obscene, harmful, harassing, defamatory or in any manner contrary to the terms of use and policies of the website, may be removed as decided solely by the operator or owner, pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).

Exemption: Content Produced by Website Operator

With regard to any visual depictions appearing on the website, for which the operators of the website may be considered “producers” or “secondary producers,” such depictions are not bound by the provisions of 18 U.S.C. §§2257, 2257A and 28 C.F.R. 75 because they do not portray actual sexually explicit activity as specifically specified in 18 U.S.C §2256 (2) (A)(i)-(iv); they do not portray depictions of the genitals or pubic area created after July 27, 2006; they do not portray simulated sexually explicit activity created after the effective date of Title 18 U.S.C. §2257A; or, they were created prior to July 3, 1995.
